Terms of Sale
- All prices and product specifications are subject to change without notice.
- Invoices will be dated the day of shipment.
- On orders to be manufactured, a variation in quantity, either way not to exceed 10% or 500 envelopes, whichever is larger, shall be accepted as fulfillment of the order and shall be paid for proportionately.
- Orders will be sent open account only to those firms with established credit. To establish credit, we require a signed credit application containing three (3) trade references, as well as your bank, a Dun and Bradstreet report if available, and ample time to investigate and approve them. All other orders will be shipped out Credit Card, net terms, with no payment discount. Delinquent accounts will be switched to Credit Card, net terms.
- We make no guarantees against unavoidable variations in shade, finish, strength, measurements, and weight of the product. All size and measurement specifications are subject to the envelope industry standard variance of ± 1/16".
- If you find it necessary to cancel an order, please contact us immediately. Depending upon the progress of the order, prior to cancellation, you may be responsible for all time and materials incurred until the time of cancellation, including a cancellation charge.
- All quotations made by, and all orders and contracts accepted by salesperson, are subject to the approval of the corporate office. Typographical and clerical errors are subject to correction.
- Due to the variety of packaging materials used, the quantity per carton on any item is always determined by the current price list. Temporary variations mean you may receive a larger or smaller number of shipping pieces.
- The shipment or delivery of all orders accepted shall be contingent on strikes, fires, accidents, delays of carriers and all other causes unavoidable or beyond our control.
- Claims for errors or shortage must be registered within five (5) days after receipt of goods.
- All shipments are delivered to the carrier in good condition, and are signed for by them as being so. Responsibility for loss or damage while goods are in transit rests with the carrier. For your own protection, damaged shipments should not be signed for until a full description of the damage is made by the delivering carrier on the freight bill. With this bill and notation as evidence, you can then file a claim for damages with the carrier. Claims for damaged goods or shortages will not be entertained by the carrier unless the freight bill contains such a notation stating condition of goods or shortages. If you give the carrier a clear receipt for damaged or short deliveries, you do so at your own risk.
- In the unlikely event we furnish you an incorrect or defective product, our liability extends only to the extent of replacing the product or, at our option, issuing a refund. We are not liable for resultant or subsequent damages.
- Merchandise may not be returned without our consent. Please call our Customer Service Department for a Return Authorization Number. All returns should be sent to our street address, prepaid. C.O.D. shipments will not be accepted. All returns must take place within thirty (30) days of receipt of goods. Depending upon the reasons for return, a re-stocking charge may be applicable. A 10% re-stocking charge will apply to authorized returns on stock items. Product must be in good condition and returned within thirty (30) days of invoice.
- All artwork, electronic or other, whether invoiced separately or not, will remain the property of Western States unless specifically stated otherwise at the time of order acceptance. If it is not requested to be returned, it will be destroyed after 6 months.
- All cutting dies remain our property.
- If copy must be followed exactly for style, type face, or art work, customers must furnish electronic art. Otherwise we will match copy as closely as possible, by typesetting. We are always happy to send you a proof, should you request one.
- When proof of printing copy has been sent for approval, we shall not be responsible for any errors or mistakes the customer fails to correct.
- Due to the variety of dyes and other materials used in the manufacture of paper, we assume no liability for discoloration of the paper itself or any inks, foils, or other materials applied to the paper, whether the paper is supplied by, or specified by the customer.
- The following conditions shall apply to orders accepted for making envelopes from paper furnished by customers.
- All shipments of blank or printed flat sheets should be sent to us prepaid, not collect or C.O.D. Please include a photocopy of your purchase order, to speed the processing time within our plant.
- We assume no responsibility for proper cutting of envelopes from sheets printed according to any layout not approved by us.
- Such paper shall be well jogged and packaged by the customer, and shall be free of damaged edges. If jogging should be required prior to conversion, you will be billed accordingly for that additional operation.
- We accept no responsibility for quantity of such paper, except on special agreement with the customer and at his expense for counting.
- Due to the wide variety of different papers on the market today, the normal overrun or under run standards may not apply. Many sheets of paper will crack, tear or otherwise convert poorly, due to the nature of the sheet itself. Please consult us in advance if you have any questions.
- We do not guarantee absolute conformity of location of printing on envelopes cut from paper printed on a flat sheet.
- We accept no responsibility for printed stock if ink is not able to withstand roll or blade pressures and smears during any operation of the converting process.
